The application must be received by the CICA within two years of the date of the incident. It is likely ,however, that sympathetic consideration will be given to late applications by victims who have some form of impaired ability or who were under the age of 18 at the time of the incident, provided that the application is received within a reasonable time of the victim attaining majority.

The CICA adopts a system of penalty points outlined in its guide which will result in a percentage reduction from 0–100%. The CICA ignores convictions which are spent under the Rehabilitation of Offenders Act 1974.
