Time , place and method of grant of probate

There are 3 main types of grant of representation:

1probate;
2 letters of administration (with will annexed);
3 letters of administration;

Application for any grant may be made to the Principal Registry, or any district probate registry or sub-registry. There is no territorial jurisdiction restricting applications to particular registries. Application may therefore be made to any registry irrespective of the applicant’s location or the deceased’s last residence.

Application for a grant of representation may be made at any time after the deceased’s death. There is no time limit within which application must be made. However, without the leave of a district judge of the Family Division, or the registrar of a probate registry, no grant of probate or letters of administration (with will annexed) may issue within 7 days of the deceased’s death and no grant of administration within 14 days of such date.

Application may be made by post or personal attendance. Application for a grant requires an oath in support of the application. The oath may be sworn or affirmed before a commissioner, solicitor or an authorised court officer, but cannot be sworn or affirmed before a solicitor, partner or member of the Institute of Legal Executives in the firm acting in the proceedings. The oath can now be sworn before a justice of the peace or stipendiary magistrate in their official capacities. General notaries may administer oaths. Members of the armed forces serving abroad may be sworn before officers of appropriate rank.
