Claim upon death of mother

A claim is made for the cost of replacing the services which had been rendered free of charge by the deceased wife based on the cost of procuring the services of a housekeeper or maid, and if necessary, providing her with board and lodging.

Alternatively, instead of employing a housekeeper, the husband may reduce working hours or give up work entirely to look after the children. His loss of wages can properly be claimed as dependency loss if they are less than the cost of employing a housekeeper or other similar aid.

Also damages for the loss to the children of their mother’s attention has been recognised as a valid head of claim based on the fact that the mother does not work set hours, is in constant attendance upon her family and is able to give instructions to the family on matters essential to their well being.
