The claimant suffered high-frequency sensorineural hearing loss in both ears as a result of exposure to loud noise in the defendant’s factory .

He first became aware of a gradual loss of hearing at the age of 35.

At trial he could follow conversation in a quiet one-to-one situation but noticed difficulty where there was any competing background noise. He had problems conversing while in a group and when being spoken to while on shopping trips. He required the television to be on at a high volume. He did not complain of tinnitus but had heard ‘high-pitched whines’ occasionally. The extent of his hearing loss in his left ear was 10 dB at 1 kHz, 15 dB at 2 kHz, and 15 dB at 3 kHz. In his right ear 20 dB at 1 kHz, 15 dB at 2 kHz, and 15 dB at 3 kHz. His binaural hearing loss averaged over 1, 2 and 3 kHz was 13.33. The findings were characteristic of noise trauma.

The hearing loss was permanent and would be expected to deteriorate slowly with age. Award £5,500.00.

Case study

The plaintiff trapped the fingers of her left hand in the rollers of a machine at the factory where she worked as a charge hand. She sustained fractures to the distal phalanges of her ring and middle fingers of her un-dominant left hand. She also sustained significant bruising over the proximal interphalangeal joint of her little finger. She was in considerable pain for one month after the accident and thereafter there was gradual improvement.

She suffered some sleep disturbance and had problems carrying heavy shopping. She took no time off work but lightened her duties for three weeks after the accident.

At the date of the trial, there were some minimal residual symptoms including sleep disturbance and loss of sensation in her finger tips, particularly in cold weather. Award £1,790.28.
