The will-checklist for probate

Check that the original will is held and that it was made in the full true name of the testator. Note any differences for recital in the oath.
Check that the names of the executors appointed in the will are the full true names. Note any difference(s) or changes (for example by marriage, civil partnership or deed poll) for recital in the oath.
Check that all the executors appointed are either applying for the grant, have predeceased the deceased, have renounced their title, or wish to have power reserved. Note whichever is the case for recital in the oath.
Check that the will does not refer to any other document, list, schedule or memorandum in a way which may require that document to be incorporated as together with the will constituting the last will and testament of the deceased.
If the will contains a survival clause in respect of the executors, for example ‘I appoint … to be my executor provided that he survives me for 28 days’, check that the survival period has expired. Obviously, application cannot be made before the contingent survival period has elapsed.
Check that the will was dated and properly signed by the testator and the witnesses. Check that the attestation clause is complete.
Check the will has not been damaged in any way so that an affidavit of plight and condition is required. If the original will was in the testator’s possession immediately before his death an affidavit rebutting any suggestion of attempted revocation by the testator will be required.
Check that any codicil is with the will and that it refers to the will sought to be proved. Check that the original is held and that it has been properly executed as for a will. If there is more than one codicil check each of them. Even if revoked by a subsequent codicil, a codicil, if not destroyed, should be lodged.
